People get banned as a person. This is clearly not a person who did anything wrong...

 

I understand that it is the hacked account only that is banned but it once belonged to this person who did nothing wrong to be permed on it in the first place. The person is punished by losing the account to something he or she did not do. I don't know how easy it is to restore but what I would do is: Strip the account from any gained benefits the hacker gained on it and give it back to the rightful owner. Disclaimer: this is my opinion and I do not know how easy this is to achieve.
