Your first offence for harassment was under Peterinium for which you were banned 3 days. Since this is your 2nd offence, it will be 7 days. Note that this ban applies to you as a person (i.e. accumulative offences), thus explains the 2nd offence even though peterica itself didn't had any prior bans.
Please specify. Who was it against, in what context, what term or phrase, etc. The first offence's ban was not proper. One of your colleagues, Eli, had specified that whispers do not amount to a ban. Thus, it was deemed wrongful and it was lifted. Whispers still constitute a ban. In your case, it wasn't simply because of the context. I will review this appeal shortly.
After reviewing your first ban, indeed there was nothing bannable for it. Like what Eli said, This doesn't mean that whispers do not amount to a ban. However, for this ban would be justified as you PM-ed a player after he smega-ed with crude/uncalled for languages such as "arse" "hole" "bj", calling him a hacker, a stuck-up, "big words for a singlish man". For that, your ban has been reduced to 3 days as your first offence for harassment. My decision on this is final and binding.
Similar and equally derogatory language were used in the first ban, against a non-veteran player. The ban was, nonetheless, lifted. In the present context, I am banned for using derogatory language against a seemingly veteran player. If this is an attempt to favor the player or friend, it is wholly a misuse of position. The facts are similar. Both pertain to misuse of language against another player. The context may differ. The rule, however, as Eli made clear, is such that whispers do not amount to a bannable offence.
This is false. You misinterpreted what Eli meant. I strongly suggest you to re-visit what he said again. Key phrase: For the whispers that occurred. No where did he said that any of such languages used via whispers do not amount to a bannable offense. I'd like to emphasis that this isn't stated in our T&C as well. I'd like to bring your attention to the following taken from the T&C: The highlighted red ones are the one that applies in this case.
Both situations fall within the T&C, in its most ordinary sense; both involved alleged rude language or harassment, yet there was no ban for the first. Another situation involved repeated defaming, including vulgar language, over an FM spot, yet it was deemed as not amounting to harassment (see: https://royals.ms/forum/threads/guy-randomly-mass-defaming-foul-language.110825/). Perhaps the player had two offences, and you were unwilling to comply with the T&C to issue a permanent ban for the third. Thus far, no reasons were provided for each ban you've issued, apart from the situation falling or not falling within a particular offence, whether it be this case or a different player's case. Why did you feel it was appropriate to ban the player? What is the specific rationale? Did a previously similar case receive the same punishment? Interpret the "T&C" whichever way you wish, my allegation holds true: you're misusing your position for personal purposes.
