A new Law in Korea that persecutes private servers

    Can prison sentence and penalty solve the problem with Online game private server (aka pre-server) and Hacks?

    The revised Game Industry promotion Act, which passed the National Assembly's plenary session in December last year, is scheduled to take effect from June 21, 6 months after its promulgation. Those who produce and distribute illegal programs such as private servers and game nukes will be punished by imprisonment for up to five years or less than 50 million won according to the revised game industry promotion law.

    The main difference between the existing game industry promotion law and the revised bill is that it defines illegal programs and provides punitive provisions. Existing legislation defined only games that did not display ratings and content information, and games that were not reported as sales as illegal games. However, the amendment has made it illegal to create and distribute secondary programs that were not provided or approved by game companies.

    In other words, all secondary programs not authorized by the game company are included in illegal games. Typically, there are private servers, online games, nuclear programs, and pirated games called free servers. Any kind of add-ons, unpacks, unofficial patches that do not harm other users are also illegal in principle unless the game company permits them.

    Even if the distributor is a foreigner or an overseas resident, it is hard to avoid punishment. Article 13, which specifies the protection of game intellectual property rights, establishes a grounding clause in which the Minister of Culture, Sports and Tourism may request cooperation from the head of the relevant central administrative agency if necessary.

    Therefore, if a foreigner or a foreign resident infringes a significant intellectual property right, the Minister of Culture, Sports and Tourism can request a procedure for securing identity through the Ministry of Foreign Affairs. This means that it is easier to prevent the provision of private servers, imitations, and replicas of domestic games from domestic and overseas, as well as overseas private servers and private programs for domestic users, and to provide them to their own citizens.

    4. The Minister of Culture and Sports may request the director of the relevant central administrative agency to cooperate with the relevant system in order to protect the intellectual property rights of the game.

    The bill was amended to provide clear definitions and legal penalties for illegal private servers and illegal forgery programs for online games, and to establish grounds for responding to the imitation and reproduction of domestic games by overseas game companies.

    The amendment bill for the Game Industry Promotion Act will be enforced on June 21, and a person who has committed illegal acts will be punished by imprisonment for not more than 5 years or a fine not exceeding 50 million won.

    As a loyal Royaller, myself and my guild (korean guild) were greatly disturbed by this news. I believe royals have survived for many years with superb defensive mechanisms but this time it is not merely Company vs Individual but more of Country vs Individual. Is royals safe and can I lay down my worries? What do you guys think?

    What an odd world we are living in...Terrorist attacks occur on a daily basis, countries are getting bombed for made up reasons, hunger, homelessness and poverty are skyrocketing, national debts are growing each second and they are messing with "Maple Story private servers...Really?

    Makes you wonder if we really need our incompetent governments at all.

    It's just like the whole SOPA thing. Makes my blood boil.

    Can confirm this is legit since someone (who is Korean ofc) that ran a big server got a lawsuit on him.

    KMS (Korean MapleStory) open announce too they are hunting, but I wouldn't worry about that since they make such blog posts since like 2015 and nothing happened for non-korean people.

    This is a law in korea for any Private Server, not MapleStory

    I wouldn't worry though like post #2 says. If you aint in Korea, this doesn't matter... unless Nexon of America isn't pleased like back in 08.

    as long as people can profit off of suffering they will continue to do so, and the suffering will not cease
    the solution will be to make them too scared to do so
